When using Jukusui no Jutsu is the subject allowed a save right when they are touched or just when they take damage equal to their con score?

It is just when they take Constitution damage.

no, it is when you take damage equal to your constitution. I think you meant to say that, but one can never be too sure anymore. |

You save right away and when you take damage equal to your Constitution score.

That is exactly what I meant, sorry. Implication being that until you take damage to your Constitution score, you don't save. (Implication failed.)
